Please read these terms carefully before using our services

Welcome to Omega Technology. By accessing our website and using our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

These terms apply to all services provided by Omega Technology, including but not limited to website development, social media management, email marketing, graphic design, and branding services.

1. Services Overview

1.1 Social Media Management

We plan, edit, optimise and automate your social media for growth. Our services include content creation, caption writing, hashtag research, scheduling, and performance reporting.

Optional Filming Add-On:

  • Filming is NOT included in standard social media management packages
  • £50 for 2 hours of filming
  • Camera operator is an external company brought in by Omega Technology
  • Subject to availability
  • All editing handled by Omega Technology

1.2 Website Development

We provide professional website design and development services, including standard business websites and high-performance growth websites.

Ongoing Website Plan:

  • £25 per month ongoing maintenance fee
  • Continues until you wish to discontinue the service
  • Includes hosting, security updates, ongoing support, and free edits (10 per year for standard sites, 20 per year for e-commerce)
  • You may cancel at any time with written notice

1.3 Other Services

Additional services include email marketing, graphic design, branding packages, and digital marketing consultations. Specific terms for each service will be outlined in your service agreement.

2. Payment Terms

2.1 Initial Payment

For project-based services (website development, branding packages), we typically require a 50% deposit when work commences. This deposit is non-refundable once we have started working on your project.

2.2 Final Payment

The remaining 50% balance is due before the website goes live or before final deliverables are handed over. We reserve the right to withhold access to completed work until full payment is received.

2.3 Monthly Services

For ongoing services (social media management, email marketing, website maintenance), payment is due at the beginning of each month. Services may be suspended if payment is not received within 7 days of the due date.

2.4 Payment Methods

We accept bank transfers, credit/debit cards, and PayPal. All prices are in GBP (£) and are subject to VAT where applicable.

2.5 Late Payments

Late payments may incur additional charges. We reserve the right to charge interest on overdue invoices at a rate of 8% per annum above the Bank of England base rate.

3. Refund Policy

3.1 Project-Based Services

Due to the custom nature of our work, deposits are non-refundable once we've started the project. However, we work closely with you throughout the entire process to ensure you're happy with the direction.

3.2 Monthly Services

For monthly subscription services, you may cancel at any time. Refunds are not provided for partial months. Your access to services will continue until the end of your paid billing period.

3.3 Disputes

If you have concerns about the quality of our work, please contact us immediately. We are committed to resolving any issues fairly and professionally.

4. Client Responsibilities

4.1 Content Provision

You are responsible for providing all necessary content, images, text, logos, and materials in a timely manner. Delays in content provision may result in project timeline extensions.

4.2 Feedback and Approvals

You agree to provide timely feedback and approvals during the project. Each project includes a specified number of revision rounds (typically 2 rounds). Additional revisions may incur extra charges.

4.3 Accurate Information

You must provide accurate and complete information about your business, including contact details, service descriptions, and any legal requirements.

4.4 Access and Credentials

For social media management and website maintenance, you agree to provide necessary access credentials and maintain communication throughout the service period.

5. Intellectual Property

5.1 Ownership of Deliverables

Upon full payment, you own the final deliverables created for your project (logos, website content, graphics, etc.). However, Omega Technology retains the right to showcase your project in our portfolio unless otherwise agreed in writing.

5.2 Third-Party Resources

Some projects may incorporate third-party resources (stock photos, fonts, plugins) that are licensed separately. You are responsible for maintaining any required licenses for these resources.

5.3 Client Materials

You retain ownership of all materials you provide to us. By providing materials, you grant us a license to use them for the purpose of delivering our services.

5.4 Pre-existing IP

Omega Technology retains ownership of any pre-existing intellectual property, methodologies, and tools used in the creation of your project.

6. Service Level & Timelines

6.1 Project Timelines

We provide estimated timelines for each project. While we strive to meet all deadlines, timelines are estimates and may be affected by factors including client feedback delays, content provision, and scope changes.

6.2 Support Response Times

For ongoing services, we aim to respond to support requests within 24 hours on business days (Monday-Friday, excluding UK public holidays). Emergency support may be available for an additional fee.

6.3 Service Availability

We make every effort to ensure continuous service availability. However, we cannot guarantee uninterrupted service due to maintenance, updates, or circumstances beyond our control.

6.4 External Services

Services provided by external contractors (such as filming services) are subject to availability and are coordinated by Omega Technology. We are not liable for delays or issues caused by external service providers.

7. Cancellation & Termination

7.1 Client Cancellation

For project-based services, if you cancel after work has commenced, the initial deposit is non-refundable and you may be charged for work completed to date. For monthly services, you may cancel at any time with written notice, effective at the end of your current billing period.

7.2 Omega Technology Termination

We reserve the right to terminate services if payment is not received, if you breach these terms, or if the working relationship becomes untenable. In such cases, you will be charged for work completed to date.

7.3 Website Maintenance Cancellation

For the ongoing website maintenance plan (£25/month), you may cancel at any time. After cancellation, you remain responsible for your own hosting, security, and maintenance arrangements.

7.4 Post-Termination

Upon termination, we will provide all completed deliverables that have been paid for. You are responsible for securing copies of all your data before termination.

8. Warranties & Liability

8.1 Service Quality

We warrant that our services will be performed with reasonable skill and care in accordance with industry standards. However, we do not guarantee specific results, rankings, or business outcomes.

8.2 Limitation of Liability

To the fullest extent permitted by law, Omega Technology's total liability for any claims arising from our services is limited to the amount paid by you for the specific service in question.

8.3 No Liability For

We are not liable for: loss of profits, revenue, data, or business opportunity; indirect or consequential losses; issues caused by third-party services or platforms; or losses resulting from your failure to follow our recommendations.

8.4 Client Warranties

You warrant that: all materials you provide are legally owned by you or properly licensed; your use of our services complies with all applicable laws; and you have authority to enter into this agreement.

9. Confidentiality

9.1 Confidential Information

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of our working relationship.

9.2 Exceptions

Confidentiality obligations do not apply to information that: is publicly available; was known before disclosure; is independently developed; or must be disclosed by law.

9.3 Data Protection

We handle your personal data in accordance with UK GDPR and our Privacy Policy. We implement appropriate security measures to protect your information.

10. General Terms

10.1 Changes to Terms

We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services constitutes acceptance of updated terms.

10.2 Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

10.3 Entire Agreement

These terms, together with any service-specific agreements and our Privacy Policy, constitute the entire agreement between you and Omega Technology.

10.4 Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

10.5 Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, wars, or technical failures.
